In 2009 it was announced Ben would be joining ex-Evanescence rhythm guitarist John LeCompt and drummer Rocky Gray along with former American Idol contestant Carly Smithson (Vocals) and bass player Marty O'Brien to form We Are The Fallen. The group released their debut album "Tear The World Down" on May 11, 2010.
On August 24, 2010, Ben posted an open letter talking about his split from Evanescence, claiming his band We Are the Fallen was not intended to exploit Evanescence, and asking fans not to cause drama anymore.
